Builder refuse to re-decorate property

Hi all,

I need a bit of a help and advice.

I need help and advice from those who already escalate matter further via the code for home builders dispute resolution scheme.

As soon as I moved in I have instructed snagging instructed to run a report for me. He has identified 324 defects and the report was handed to the builder. Since November various people has been visiting my property in attempt to rectify defects with no joy. By repairing one another caused and so on. Or the quality of work despite a numerous repair has not improved.
The builder does everything possible not to fully redecorate my house. But as per various contractors to rectify defect proper, neat and in workmanlike manner they need fully redecorate whole house.
For repairs different construction materials has been used and the colors and finishes do not match. The matte window sill painted gloss and with tiny bubbles and dust stuck in it. The magnolia paint on the walls does not match with original magnolia and everywhere where builders touched patches prominent. Today when I requested manager to come down as I do have some concerns regarding finishing touches, workmen told me of
f and stated they are not going to be told how to do their job and left my house in despair. Customer care manager is not interested and claims that the decorative finish is acceptable and he wants me to complaint to NHBC. My house at present looks like trash. I have reviewed builders complaint procedure and it become evident that I must first to complain to regional manager which am done.

HELP what evidence do I need to gather. The builder stated am a problem customer and they knew they will have problems with me.
They builder already attempted 3 times to rectify defects with no joy.
At some point builder said I am not cooperating. Despite I am open to conversation, I am reporting in writing all my concerns. I am not rude to workers, always provide access etc.
I do have a feeling that complaint to regional manager will take me no where.

decor is one of the worst problems to get resolved with a builder , because to some extent the quality of finish can be subjective

it sound here , as though your builder accepts that there are issues but fails to deal with them

OK , so if you think that you have run your course with builder , then if you have NHBC warranty the next step is to make a claim under your warranty contract , AS THE BUILDER HAS FAILED UNDER THE TERMS OF HIS DEFECT WARRANTY PERIOD

The "builders code of conduct" you refer to is , a waste of paper you can download it from the net ,its designed really to advise buyers during the process of buying of their rights

call the NHBC , speak to the claims dept and tell them whats happening , they will talk you through the process

there is a NHBC claims charter you can download too , a quick search on the net will find it

Thank you Steve for your reply. I do understand that decorative finish is hardest to fight. As an example I have added few photos to show why am not satisfied.

Paint Problems

We have had the same problem with David Wilson Homes South West where they wanted to complete a damp and mould problem by using ordinary paint and painting only half way up the wall. This was a statement made in writing by their Customer Service executive who has as much knowledge of paint as my cat.
I immediately contacted Crown and Dulux by e mail for specifications which they sent. I then sent the specifications to DWH South West asking them to complete the remedial to acceptable industry standards. They then had no choice as all their literature tells us all how high their quality standards are.

I would go straight to the NHBC and request a resolution meeting. Your painting is a similar poor standard to ours and the NHBC have stated that full redecoration of the gloss is required.

Our local NHBC man has been very helpful and also let slip that the builders now have to pay the NHBC for resolution meetings (£300 I think) as they are now having to attend so many!

I had the NHBC over, just one excuse after another. Corners and edges don't have to be completely 90 degrees, they have way too much wriggle room. One moment they talk about " visible from 2 meters away, another time a certain amount of mm is acceptable despite it looking completely off

I'm pretty sure my walls are slightly wavy and the ceilings aren't 100% level, but I know the NHBC won't measure properly when I have them coming back next week.

Decorating nightmare

It sounds as though it is time to kick the table over.

1. Freedom of information request on the builder.
2. Check for breaches of the Data Protection act. If you spot any, complain in writing. Then if no reply, letter of complaint to the ICO.
3. Get quotes in writing from two professional companies to put the job right to industry standards.
4. Send quotes to the builder and if no reply get the work done and invoice the builder.
5. If they do not pay in a set time then complete form N1 and go through the small claims court for recovery.
6. Always ensure all action is in writing. NO TELEPHONE CALLS
