Default Access to developer's property

I have a damp new build flat. The damp appears to be coming from incomplete basement flats. Zurich have asked the developer to put things right which they appear to be doing with the use of kitchen and bathroom paint. Now I'm no expert but I am suspicious that that won't fix the problem. Zurich are being unhelpful and will not send someone round to check that the work to fix the damp is being completed correctly.

Do I have the right to access the basement flats with a surveyor to check on the work?

Relations with the developer (who is also the freeholder and managing agent) are such that we have received abusive and threatening phone calls. Zurich have informed me that they are just an insurance company and cannot get involved in 'personal problems'. According to the policy we have to give the developer access to our home.

Do the threats mean that we have the right to deny them access without invalidating the claim?

Man on phone at Zurich says we have to let them in. Can that really be the case?

Default Re:Access to developer's property

I am not sure I fully understand the issue, but if you have no confidence in the suggested remedial work and Zurich will not get involved then I would advise getting the opinion of a professional either a surveyor or somebody in the trade. If you ask them just to llok at this issue, it should not cost much.

I hope this helps
