Default boundary dispute

Hi I bought a new house from Drumbow and moved in on the 01/12/05. Yesterday 18/12/05 they came and moved my boundary fence - due to a complaint from my neighbour. I was never advised that there was an issue and on checking my feu plan is would appear that the fence was actually in the correct position to start with!! There is just enough room for my neighbour and I to park side by side on the drives and get the doors open on one side of the cars only.
I feel the builders have made an error with the gap size between the houses and my neighbour has been left with a drive that it too narrow to actually use and they have solved this by getting the builders to move the fence. The house next to me was orignally going to be a detached but ended up as 2 semis hence the problem now with the driveway widths.
Were do I go from here?? My lawyers seem the only way forward but I would like to know my legal position before approaching them.
Can anyone help??

Dear Scottp197,

I would contact your lawyer to help you get this resolved, as this could lead to issues when you come to sell.

If the driveway is also used to access the front door then there are regulations about width, basically there has to be enough space to get a wheelchair down the side of the car to the fornt door.

Narrow drives and garages is a common problem with new builds:

Thanks Tony I will.

Interesting comment re the wheelchair access from the driveway, now I know why my neighbour and I are the only two with houses with seperate paths from the pavement to the front doors instead of one leading off of the drive. I can't get my son out if I park up passed the front of the house, anyone with a wheelchair would be completely stuck especially as the drive has a nasty slope down to my neighbour's house. Definately not disabled friendly. The perils of buying off plan!!

Shouldnt your solicitor (laywer is so american !!!!) have shown and explained to you, your boundarys ? to many solicitors get away with murder, they do a poor conveyance and get away with it because most people wont challenge them, oh and they charge you a fortune for the pleasure :sick: :sick:

I Think you got it wrong? Your Title plan clearly indicates in red the land that you are entitled to. Its not polite to erect a fence in your neighbours garden without permission. If you have any doubts you should contact your lawyer. inch:

also if you take along the documents that show the boundaries of the two properties it will help support your argument, if you're right that is!
