What is the situation where you have taken several days off of holiday entitlement to let the builder fix a snag, yet the snag still remains un-resolved to my satisfaction. These times have been so the fault could be inspected. The builder 'Persimmon' has had several attempts to fix it now and each time I have to take Holiday to supervise them or to let someone in to inspect.
Anyone got any advice on if you can get compensation?
For the detail on the issue:
The carpets and vinyl were fitted by a contractor, yet the dust/dirt wasn't cleaned up. The plaster splash was not scraped from the floor leaving bumps and in some placed hole were not filled in. These can all be felt under foot through the carpet. The contractor and builder have argued who's responsibility it is, but it keeps affecting me. Im also concerned that the carpet is now full of the plaster and cement dust, which will affect my young kids playing on the floor.
Any advice much appreciated.
If they repeatedly fail to properly fix the defect and you can show you officially booked holidayb leave to enable remedial works to be done then you do have a case for compensation.
All house builders will fight tooth and nail against paying any compenstation as it opens the floor gates as the news spreads by word of mouth on a development. But that deos not mean it is never paid!
Regarding your defect, the builder should have ensured the floor was properly cleaned and any large holes filled before carpet was fitted. However the carpet contractor should have made the house builder aware that the floor was not clean and refused to lay the carpet until it was acceptable.
If however, the carpet contractor was arranged and paid for by you and not the house builder, then you will have some liability and will have to deal directly with the carpet contractor yourself.
