misrepresentation vs delay
we reserved a plot/house that was due for completion nov/dec 07 on 3/8/07. We were due to exchange 30 days later. The weekend before we exchange we visited the site to clarify the approx completion date and were assured it was still nov/dec 07. three days later we exchanged and gave our 10% (£30,ooo) deposit. We then received a welcome letter stating that all was well for our completion in aug 08. We were shocked and called the site. We were told it was a typing error and we received a new letter stating the completion date to be jan/feb 08. Again we were shocked. We had no communication from the builders explaining the reason or even stating the delay. We were told 3 weeks ago that they would be ground breaking however we have found out today (by visiting the site) that nothing has been started. After talking to the sales people on site we were told it would take 5 months to build the house - this takes up up to at least apr 08 (if they start now). What recourse do we have. Our contract doesnt state a completion date. However all other paperwork does. And when does building delays become misrepresentation/taking money on false pretenses.
Our original completion was nov/dec 07 and here it is nov 07 and the ground hasnt even been broken.
