Default Dimensions different to specification

Can anybody help, I am in the process of buying with Charles Church and have had someone in professionally to snag. Not sure what the outcome of this will be yet as not yet had my 'snagging' meeting with them. Can't believe its been signed off by NHBC and Charles Church even though there are some serious defects.

Can anyone give any advice on where I lie if the dimentions are different to that specified. I was told that my house would replicate the show house to the cm but it doesn't. Is it tough luck on me?

think they are allowed up to 2 inches either way for each room

Thanks, can you just give me a bit more information.

On the top of the stairs on the landing I have lost 4 inches and I was told that this was ok as they can take 2 inches off each side. This does not seem right, I think they are pulling the wool over my eyes.

Can you help?

From what I have read here a 2' tolerance is normal. I didn't think that was off both ends of the measurements though. I'm sure a more experienced member will be along in a minute to clear this up.

Hi there. Please can anyone tell me where they read the 2' rule or where I can find this information?

We exchanged on a property where the original room size (and plan) for one of our bedrooms was 9' wide, we are nearing completion and noticed went we went to look at progress that they have moved the wall in by a foot to hide plumbing coming through our flat from the flat above.

We're obviously extremely concerned and want to know what our options are as our solicitor doesn't seem to know about any 2' rule.

Hi Matt,

Please read this about room sizes

In summary, they would have provided plans for you to sign which form part of the contract. What did these say about tolerances and what does your contract say.

They may be in breach of contract or you may have an unfair contract. Give your solicitor a kick up the arse and tell her/him to do their job.

Hi Tony

Thanks for your response.

It's a real 'grey area' as our contract and the plans we signed for don't seem to have any specific tolerance at all stated. The wording of the contract relates to 'substantial and material changes' to the plan. Our solicitor isn't sure what constitutes a 'substantial and material change' and has recommended that we talk to a barrister.

We clearly think it is, but the problem is would a court?

We're first time buyers so we're not sure whether our solicitor is supposed to let us know whether this is an unfair contract or whether we are better off paying more money to speak to a barrister.

We are talking about a 10% reduction in length of one room, sounds substantial and material to me. I know someone who got a surveyor to measure up all their rooms and found that they the house was significantly smaller - I think they got £5000 from the developer.

Don't get legal just try to resolve it with the builder first.
