Further to my previous post regarding Persimmon's omission of insulation to the ground floor slab of our new home; Persimmon have now admitted that our house does not satisfy Building Regulations. Their solution is to install an upgraded boiler (condenser type to replace existing standard gas boiler) which will provide a higher SAP rating for the house and thereby satisfy the relevant regs current at the time when our development was given approval - around 2002. This will still leave our ground floor with no integral insulation. Does anybody know if this is a legitimate fix? Can we insist that the original specification is adhered to? Can the requirements of current regs be insisted upon if the house doesn't currently meet building regs? Any advice welcome - even from tonyw!!

i know its late and you may have since solved you're problem but for persimmon to miss insulation from the floor is crazy.
I'm a licenced SAP Assessor and i'm that without insulation in the floor, you're home would not have acheived the minimum U Value stated in building regulation part L1:2002.
The minimum U Value is 0.25 W/m2k.
You can be flexible with this value and it can rise to 0.7 W/m2k (which is a poorer value) if you compensate
by improving something elswhere in the building, however i wouldn't take the developers word that it passes and would ask persimmon for an independant SAP assessment.
