Developer's u-turn over boiler repairs

This house is only a few doors from me.

Can anyone confirm that if the developer was forced into changing the Hot Water system and/or boiler, is there a legal obligation for them to install an energy efficient appliance i.e. an A-Rated boiler? Or can they jsut simply replace the boiler for a new unit of the same type? :S
