| Persimmon snag list
Hi I bought your excellent snag list, and I completed it 25th June 2005, over 280 snags, some very serious.
It is now 18th February 2006 and I am still chasing them daily to finish the work to complete the snags.
They are becoming increasing difficult now refusing to come and do the work at the weekends, even though they also declined my offer in September that I would make myself available at home every day to allow them to complete the work during the week.
Currently I have plumbing problems reported on the 30th August 2005.
I have a new problem of damp spreading down a wall from a velux window, they inspected from the outside and said it's all fine and just condensation.
HOW? There is a damp path the size of a broadsheet newspaper to the left of the window. There is not and never has been any condensation on this window (it is above the stairs).
I am at a lost as to what to do now, I am fed up of constantly chasing them and I just want to take them to court and fine them for millions for the loss of enjoyment of my brand new home, and all the hours of my life I have eben forced to waste chasing them.
A very unhappy Persimmon customer

Hi Webmasterpolo,
If you haven't done so already you need to escalate this to the head office in writing.
If you have done that then take your complaint to the NHBC, I believe Persimmon Homes usually use the NHBC. It is probably worth doing this anyway to get a second opinion regarding the window.
Keep meticulous records and use registered post, which will be extremely useful if you need to take things further.
Hope this helps,
Tony

I have done all of the above and am now about to commence litigation with Persimmon Homes for diminuation of the value of my home. I bought an ex-show home - everything that could be wrong is wrong - to the point that neighbouring properties are not built in accordance with the approved plan. Persimmon are quoting some legal case which gives them the right to change without consultation - does anyone know of this ?
Anyhow Ive had the NHBC out who suprise suprise sided with Persimmon - despite the fact that the defects are visible to a blind man on a galloping horse !
Its obvious who is in who's pocket isnt it !

From OFT Web site Quote: |
The Unfair Terms in Consumer Contracts Regulations 1999 (UTCCRs) superseded the UTCCRs 1994, and apply to standard contract terms used with consumers. The UTCCRs protect consumers against unfair standard terms in contracts they make with traders. The OFT, together with certain other bodies, can take legal action to prevent the use of potentially unfair terms. A term is likely to be considered unfair if it causes a significant imbalance in the parties' rights and obligations under the contract, to the detriment of consumers. The UTCCRs say that a consumer is not bound by a standard term in a contract with a trader if that term is unfair. Ultimately, only a court can decide whether a term is unfair

Hi Fuming Makem,
You are correct in saying the NHBC are in Persimmons Pocket and vice versa, i've had 2 resolution reports and the NHBC have deemed some of the obvious defects as not to be a defect in there eyes and Persimmons, the NHBC dont even test for any defects by using any equipment or they dont even bring in or take any notice of independant tradesmens reports in case they upset the builders, the whole process stinks and should be overhauled by the Government to protect new home buyers. Persimmon hit record profits again (600+million for 2005)including our 220k.
More and more people need to complain, but most people can't be bothered too, apart from the people who visit this site that is.

#6 | | Guest | Persimmon Previous Posts ?
Hi Tony,
Can you enlighten me as to where all my previous posts have gone regarding Feeling the cold in your persimmon home etc, this and many others had been posted during 2005.
I am assuming that Persimmon asked you to remove them because they were very concerned that what i wrote told the truth about Persimmon Homes NW and it may affect peoples decisions on purchasing a so called new home from them that is :
1) Insufficiently 'Partial Cavity Wall Insulated' with the thinnest Kingspan boards that have been fitted by a bricklayer if he can be bothered in all sides of the house whilst he builds the actual walls in rainy and icy conditions unsupervised by site foreman who are just there waiting to collect there pension
2) Draughts through out the whole house via the windows vents / frames, doors, patio, letterbox, pipework, open ended boxing etc
3) Losing heat thru the under thickness loft insulation that is incorrectly fitted and does not cover the whole loft area (Note no snow ever sticks to any Persimmon NW home roof due to the heat escaping thru the loft and then the roof warming the tiles instead of the internals of your home)
4)Undersized radiators and boilers (get your boiler model no and compare it for the size of your property via the boiler brochure or website)
Am i correct Tony ?
Thanks

I can't remember what was in the post to be honest.
I think statements such as 'they are robbin bazzers' could be taken as defamatory. I would appreciate it if you could remove them.
Cheers,
Tony

 ... very sorry Tony if I caused you any grief with my descriptions of the carpentry on those 2 ( now unnamed ) sites !!!
I think its a bit rich that national building companies are only too willing to accept all the plaudits going from the media or Joe Public but get all miffed when they,re criticised !!!!
I could back up everything I said if I could transfer pictures from my husbands camera to this site
Again I,m sorry Tony but I do think Persimmons are being over sensitive !!! if they did the job right in the first place there,d no problems !!!
