Default Payouts over 'cowboy' builders upheld

By Richard Blackledge
THREE South Yorkshire couples who were victims of "cowboy" builders have been told they can keep more than £100,000 compensation - after a developer lost an appeal against the payout.
Philip and Caroline Strange, Craig and Donna Butcher and Geoffrey and Doris Lancashire all bought brand new houses in Cooper Close, Brampton Bierlow, Rotherham, in 2001.

But the properties soon began falling apart, with fragments of brick falling ADVERTISEMENTfrom the exteriors of their dream homes, a court heard.

And when construction firm Westbury Homes Ltd hired "cowboy" builders to repair the damage, things got even worse, barrister Jonathan French told the Court of Appeal.

He told how the couples had their gardens trampled on by workmen, who also urinated against their homes and put solid waste down their drains.

Work which was supposed to last two weeks went on for three months, the barrister added.

When they complained, pensioner Mr Lancashire, who is in his 70s, was sworn at, Mr French told the court, Mr Butcher was threatened with arson - and the remedial work carried out by Pennine Exterior Restorations Limited wasn't done properly.

At the original hearing, the couples were awarded £80,000 between them to pay for restoration of the brickwork.

Each couple was also given £5,000 for the drop in value of their homes, and £2,000 compensation for distress suffered.

However, Westbury - which has since been taken over by Persimmon Homes - challenged the amount of compensation it was asked to pay.

Sir Anthony May, Lord Justice Dyson and Lord Justice Wall were told that fresh repair work could be done more cheaply than the sums awarded - but the judges dismissed the appeal, upholding the compensation as "reasonable".

Mr Strange, Mr Butcher and Mr Lancashire welcomed the ruling. "The decision is just sinking in, but we are very relieved and delighted that the previous decision has been upheld. It has been a nightmare for the last eight years," they said.

We've decided to change the property, and we have chaged it for Bryant Homes, one of flats in Limes Park. We think it will be better choice
