    Hiya! Yup they agreed to that clause without any problems, we didn't ask them ourselves just asked our solicitor (the one recommended by Barratts) and she talked to Barratts and they agreed to the clause. Glad we did get it as we completed only a few days before the mortgage offer expired!!

    Great thanks I will give it a try- missives are on their way to my solicitor now. Only thing is I've not gone with the barratts recommended one - I hope that doesn't affect it. Oh wow that was lucky for you! May I as when that was- was it in 2010?

    Charles Church just won't agree to anything. Their penalty was 12% + RBS Base rate per annum if not completed on time and if they sell the house for a loss then you take the hit. I suggested reducing this to 8% +BR as other builders didn't charge so much. While they were taking longer than expected to exchange contract (over the 28 days as stipulated surprisingly) I pulled out having originally informed their solicitor of the intention to proceed. I can now sleep without worry and let my house sell without the added pressure.
