This was my initial thought, but looking into it a bit deeper it is clear that consumers have more protection than before even with a voluntary code.
The Consumer Protection from Unfair Trading Regulations 2008 will apply to any house builder signing up to the new code of conduct, specifically section 5 which states: A commercial practice is a misleading action if it concerns any failure by a trader to comply with a commitment contained in a code of conduct which the trader has undertaken to comply with.

The OFT have also set out timelines and milestones and will recommend statutory measures if these are not met.
