Poor sound proofing

I purchased a flat about 2 years ago from Wimpey ; I am the second owner and I find the soundproofing to be extremely poor to the point where I cannot wait to move out and find somewhere else. The main problem is the flanking noise from the flat upstairs. All it takes is for them to drop something heavy or walk in platforms, flipflops and thats it. I get to hear every squeak, every bang from the cupboard, footsteps, the sound of someone sitting heavily on the sofa. . NHBC won't touch it as this is not covered and Wimpey have assured me "ha ha" that the soundproofing was tested as excellent and I am obviously mad. I hear less from the floor of my parent's home upstairs. In fact I hear nothing. It is shocking that they have got away with this. It is about 5 years old.
