Default Guttering fell off after 20 days!!!

Hi,

Both my front and rear guttering fell off my new build Persimmon home 20 days after my moving in date. Persimmon state that this was due to "adverse weather and heavy snow" and that is my responsibility to fix. They also state that following "external inspection" the fixing brackets were 1 metre apart therefore this covers any responsibility they may have. Surely this is so wrong?!!

Absolutely that is wrong. How many other homes lost guttering in the recent bad weather. Let me think for a moment - none that they know of. I bet they told you to claim on your home insurance - this will result in your premiums going up next year.

Write to them and state that you do not believe that the guttering was installed in a "workmanlike manner" and you will be taking your complaint to the NHBC in the first instance unless they are fixed within seven working days.

Does the expression "workmanlike manner" hold some weight in the construction world?

It is specifically mentioned in the NHBC standards - it is about "reasonable care and skill" the wording in Supply of Goods and Services Act. New homes are excluded from the Supply of Goods and Services Act 1982. However, it is an implied term in any contract for services.

So it is reasonable to expect reasonable care and skill. If they are troublesome you could always make a small claim.

Hi, my parents have had the some problem with their george wimpy home... this is the second year the gutters have all fallen off. This year it took the facia's with it and so one of the bedrooms took in water. Their's are falling off because they are not secured through the facias to a hard surface at the back. They've said the same thing that it's our responsibility. I would agree with Tony, and we are doing the same. let me know how you get on.

I have no luck with new builds, Builders hate me Oops...
